1. GENERAL INFORMATION

 

 

 

Vehicle Supplier and rental services operated in Romania AMA RENT A CAR is: SC AMURO RENT SRL , J22/1342/2018, unique registration code (RO) 39391508, called in the following "service provider" or AMA RENT A CAR.

Your booking may have been made through an intermediary (e.g. booking website, travel agency or company). The holder of the rental contract is the signatory of the rental contract who directly and explicitly assumes the rental conditions.

The rental agreement/contract documents include the following :

the rental contract, the vehicle condition reports (reports) at handover/return, other attachments, if applicable terms and conditions of car rental in Romania (specific local conditions)

general terms and conditions of rental Ama

 terms of the privacy policy

Rental terms and conditions (local and general terms and conditions, together referred to as Terms of Service) are available on the AMA Rent A Car website. www.ama-rentacar.ro and at the pick-up points (on tablet or/and printed on request) and are sent via link or on durable media (on request) to the e-mail address you indicated at the time of booking or at the time of concluding the rental contract. At your request, the brochure - Terms and conditions of car rental in Romania (specific local conditions) is made available to you free of charge. In the contractual relationship with you, the conditions of service provision published on the AMA Rent A Car website in the version valid at the time of your rental are directly applicable.

IT IS IMPORTANT TO READ THE RENTAL TERMS AND CONDITIONS because they contain important information about your rental, products, equipment, insurance and additional protection services, your rights and responsibilities, concrete guidelines for specific situations, fees, charges, damages and the limits of your financial liability. By signing the rental agreement, the terms and conditions of the rental (the terms and conditions of service provision) become an integral part of the rental agreement.

 

Please ask the rental agent for any necessary clarification before signing the rental agreement. It is important for you to understand the terms and conditions of the rental, and it is important for us that you are informed, because the responsibility of using the vehicle as a good owner and returning it to you in the same condition in which it was made available to you is yours (except for normal wear and tear).

Please read the terms and conditions of the privacy policy available on the AMA Rent A Car website, i.e. the Privacy Notice.

 

The rental agreement is signed by you in holographic, electronic or paper form. You agree that in your contractual relationship with the service provider you may use both a holographic signature on paper and an electronic signature and that the latter has the same legal effect as a holographic signature on paper. You have been informed and understand that the data relating to the electronic signature and the documents signed in this way will be stored in a secure manner and will only be used for the purpose of processing them for the provision of the rental services.

Avis PREFERRED/ CORPORATE CUSTOMERS: you acknowledge and understand that the rental terms and conditions valid on the date you present yourself for pick-up of a Vehicle apply to you, even if you are a signatory to a master rental agreement and may not be required to sign a specific rental agreement or if rental services are provided on a corporate basis.

 

IMPORTANT!

All the vehicles in the AMA Rent A Car fleet have : compulsory third party liability policy (RCA), vignette for the use of national roads and are equipped with winter tyres from 01 November to 31 March, without paying an additional fee. Additional insurance and/or protection services can be contracted separately. Payment of any other mandatory fees or charges (Fetesti Cernavoda bridge crossing fee, parking fees, any other mandatory fees or charges) is your responsibility. The service provider will charge in addition to the fee/tariff and/or fine not paid and applied by the competent authorities and the administrative fee of 25 Euro. Smoking in Ama Rent A Car vehicles is NOT allowed. You are responsible for paying a fee (penalty) of EUR 100 if the vehicle is delivered with residues and/or specific odour.

Transporting animals in an Ama Rent A Car: Permitted, free of charge, only if they are placed in special transport crates. However, you will be liable for any visible damage to the upholstery/interior of the vehicle and/or professional cleaning costs incurred as a result of transporting your animals.

Driving/relocating the vehicle outside the borders of Romania: It is not allowed to drive/relocate the vehicle outside the Romanian borders without a written authorization transmitted in electronic format from Ama Rent A Car and payment of the corresponding supplements.

Additional driver(s): permit(s), subject to presentation of the required documents and payment of the appropriate supplement. The contract holder must ensure that each additional driver mentioned in the rental contract, as well as each passenger carried in the

vehicle, respect the terms and conditions of the rental.

Young/beginner/senior driver: charge supplements and/or restrict access to certain groups of vehicles depending on the experience and age of the driver.

Optional equipment: provided on request, subject to availability and payment of the appropriate charges.

Additional options: special services provided on request, subject to the availability of the service and payment of the appropriate tariffs or supplements.

Additional protection services : reduce your financial responsibility for damages to the vehicle in specific cases (traffic accident, theft, windscreen damage) up to a certain amount (Romanian "fransiza" /English "excess." Read carefully the terms and conditions applicable if they are included in the rental rate or if you have opted for them with the payment of the corresponding fee. Pay special attention to the situations of exclusion and inapplicability of the insurance/supplementary protection service.

Administrative fees: fees charged by Avis representing the cost of administrative procedures (processing fines, damage files, etc.) Your financial responsibility: all attributable damage, if the vehicle (including accessories and equipment) is not returned in the same condition in which it was entrusted to you (except for normal wear and tear), in particular those suffered by the vehicle, up to the market value of the vehicle, to which may be added, as appropriate, the costs of transport and immobilisation of the vehicle and/or loss of use as well as any other charges, fees, penalties and/or compensation, including traffic/parking fines/special road and bridge user charges mentioned in the contract.

T.V.A.: the tariffs, fees and/or supplements indicated in the specific local conditions, booking and/or in the the rental contract include value added tax, valid according to the law. The standard VAT rate is 19%.

Special offers, discounts, promotions: If you are the beneficiary of any special offers, discounts or promotions, these will be applicable in relation to you, subject to compliance with the applicable special rules.

Reasonable use : Our services and rates assume the fair, prudent and reasonable use of the Vehicles and accessories entrusted to you. We reserve the right to refuse the rental of Ama Rent A Car vehicles to customers who, in previous contracts, have exceeded an acceptable mileage limit (5000 km/month or 800 km/weekend or 250 km/day) and/or who have returned the vehicles in a state of wear and tear that exceeds the limits of reasonable use, who have behaved in an unacceptable manner or who are in arrears.

Info COVID-19: The safety of customers and staff is of major importance to us. On the Ama Rent A Car website you will find the latest information about specific safety measures for customers and employees. If you need to return your rented car, but have been advised to self-restrain or if you have tested positive for COVID-19 please contact the rental location or write to contact@ama-rentacar.ro cat as soon as possible. Please make sure that the rented car is parked in a safe, designated place where no fines will be applied. The rental contract remains open until the vehicle is returned to one of our rental stations. If you choose to have the vehicle picked up by an Ama Rent A Car representative, the vehicle will be quarantined for the required period of time (14 days from the date of the email), then collected and inspected by an Ama Rent A Car representative. Pick-up fees will apply for locations where there are no Ama Rent A Car offices.

We are also at your disposal at tel. +40 758557799 (headquarters) from 09:00 am - 17:00 p.m., Monday to Friday for any situation or question related to your rental.

For any complaint you may have after delivery of the vehicle, please contact contact@ama-rentacar.ro. If our answer is not satisfactory, you can address yourself to the independent conciliation bodies or courts in Bucharest, Romania.

1.1. Conditions for renting and driving a Motor Vehicle (contract holder and additional drivers)

 

 

Contract holder.

To rent a car, even if you are the beneficiary of a reservation, you must present to the rental agent, in original, the following documents issued in your name, as it is mentioned in your identity card:

identity card (ID card or passport);

valid driving licence on the date of hire, corresponding to the car group of the vehicle requested and whose expiry date is greater than or equal to the estimated date of handover of the vehicle;

eligible bank card (see item 1.2. - accepted bank cards and available amount).

In Romania, the minimum age for driving a car is 18. However, depending on age and driving experience, the car supplier restricts access to certain car groups and/or charges supplements.

 

A valid driver's license at the time of rental means:

 

national permit , if you hold a driving licence issued by the authorities of EU member states, of states that are signatories to the Vienna Convention on Road Traffic or of states with which Romania has concluded a treaty on the mutual recognition of driving licences;

national driving licence and international driving licence if: you hold a national driving licence issued by the authorities of a country which is not a member of the EU and not a member of the Vienna Convention on Road Traffic or with which Romania has not concluded a treaty on the mutual recognition of driving licences or if your driving licence is not written in Latin characters (Arabic, Russian, Hebrew or Japanese characters).

IMPORTANT!

Not acceptable: copy of driving licence, replacement proof of driving licence with right to drive or expired driving licence.

Check prior to presentation at the rental office:

whether you require an international driving licence to drive in Romania, including by asking questions to our reservations department

if the name on the identity card is the same as the name on the driving licence (changing your name after obtaining your driving licence is a common occurrence and in such a case make sure you have had your licence exchanged);

if Ama Rent A Car accepts the bank card you present and you have the necessary funds;

It is your responsibility to present original ID, valid driver's license at the time of rental and eligible bank card. The rental agent will refuse the rental and Ama Rent A Car has the right to withhold the estimated cost of the rental or charge a no-show fee in the absence or invalidity of any of the above mentioned documents, as well as in the absence of the required funds on the accepted card, being assimilated to the case of no-show or culpable cancellation of a reservation.

 

Additional drivers:

You can add one or more of the following to your rental agreement May many additional drivers, if you pay the appropriate supplement and the additional driver personally presents the rental agent with his/her ID and valid driver's license. After the contract has been concluded, you can add additional drivers only after the vehicle has been checked by an Ama Rent A Car agent for any damage caused during the rental.

Additional driver supplement : one additional driver free of charge, if there are more than one additional driver, a fee of 7 EUR/day rental, maximum 10 chargeable days will be charged. The supplement is charged by Ama Rent a Car for each additional driver. The number of additional drivers is limited to 4. Restrictions on certain car groups and supplements based on age and driving experience also apply to additional drivers.

IMPORTANT!

Only the contract holder and the additional drivers indicated in the rental contract are authorised to drive the vehicle. If we find that you have allowed an unauthorized person to drive the vehicle, you will pay a penalty equal to the additional driver fee for the entire rental period plus any applicable surcharges based on age and driving experience. In the event of damage to the vehicle and/or damage to a third party* caused by an unauthorised driver, any additional insurance and protection services taken out are inapplicable. You will be held financially liable for all attributable damage as well as any damage caused to a third party*.(* The driver of the vehicle is not considered to be a third party.)

* Age and driving experience supplements are cumulative. For example, if you are aged between 18 and 21 and have held your licence for less than 1 year, the supplement for drivers under 21 plus the supplement for young drivers (between 21 and 25) and the supplement for novice drivers apply.

 

 

Eligible bank card. Deposit/Preauthorisation

 

 

 

Eligible bank card : bank card accepted by Ama Rent A Car and on which the necessary funds are available for pre-authorization/establishment of a deposit (guaranteed value) covering the estimated cost of the rental, optional products and services, the value of the liability in case of theft or accident (fransiza) and the equivalent of a full tank of fuel. If advance payments have been made, they will be taken into account. Depending on the car group of the vehicle you intend to rent, you will present one* or two eligible* cards at the time of rental:

AMA Rent A Car will block the guaranteed amount on the contract holder's eligible card. Any collection, if you have not opted for another payment method, will be made upon return of the vehicle/at the time of closing the contract.

IMPORTANT!

In the event that the amounts owed by you for any reason whatsoever as a result of your rental (including fines, damages, penalties, administration fees) are greater than the guaranteed amount and/or we are aware of the existence and extent of the amounts owed by you after the return of the vehicle/termination of the contract, subject to compliance with the legal and contractual provisions, you authorize us to debit the eligible cards with the corresponding amounts.

At the time of rental we reserve the right to carry out all safety checks and to approve or disapprove the rental on legitimate grounds, including unacceptable behaviour on the part of you or members of your group.

 

 

 

 

1.3 Means of payment on return of the Vehicle

 

 

The rental cost upon return of the vehicle/at the time of closing the contract is calculated and will be processed on the eligible card used at the time of rental or you may opt for another means of payment accepted by AMA Rent A Car. In case of opting for another means of payment, it may take up to 30 days to release the amount deducted from the eligible card at the time of rental. Avis is not responsible for the time taken by eligible bank card issuers to release or refund amounts pre-authorized or withheld as security.

1.3.a. Payment by card

 

   You can pay the rental fee with a bank card accepted by AMA Rent A Car.

CARDS ACCEPTED : Visa, Mastercard.

NOT ACCEPTED: Maestro (debit), prepaid cards - even if they bear the Visa or Master Card logo, American Express cards

Travellers Cheque, Revolut debit card, or any other card not mentioned above.

 

1.3.b Cash payment

 

 

You can pay the rental fee in cash at the end of the rental period. Cash payment can be made in RON, according to the law.

1.3.c. Payment by voucher

 

 

You can pay the rental fee using a voucher issued by an intermediary (travel agency, broker) or a voucher issued at the time of booking the vehicle, if you have opted to pay online or in advance of the estimated rental cost. You will present your voucher when drawing up the rental/pick-up contract. Voucher payments whose value is expressed in convertible currencies are valued at the exchange rate in force on the date of rental established internally by AMA Rent A Car at international level. If you choose to pay in a currency other than that used by AMA Rent A Car, AMA Rent A Car will apply the exchange rate in effect at the time of payment.

The following types of vouchers are used in the AMA Rent A Car reservation system:

Voucher with amount limit : is issued for a specific value. This value is indicated in the booking/confirmation and represents the total price of the booking (estimated cost of services). An alternative method of payment and/or guarantee (eligible bank card) is always requested when you sign the rental contract.

Full credit voucher : it is intended exclusively for legal entities that broker, pay and guarantee rentals in favour of natural persons and is not limited in value to the total price of the reservation. Any different and/or additional option of yours noted at the conclusion of the rental contract, which leads to an increase of the total price of the reservation and/or any other additional payment amount retained by AMA Rent A Car after the calculation of the final cost of the contract is guaranteed and paid according to the contracts concluded with legal entities (e.g. travel agencies, partner companies).

 

1.3.d. Invoices

 

Invoices are issued in the name of the contract holder, or as the case may be in the name of the travel agency and/or AMA Rent A Car partner company that placed the booking order for you. In all cases, the contract holder is identified on the invoices issued and is generally jointly and severally liable for all financial consequences of the rental. If you are not a corporate client (in which case invoices are automatically issued in the name of the AMA Rent A Car partner company) but you wish to have invoices issued for a legal entity, you may request this within a maximum of 30 days from the closing of your rental contract, subject to the payment of the due payments according to the contract and, if applicable, the provision of the requested information and other necessary verifications.

1.4. Taking over the vehicle

 

 

  • Before signing the Rental Contract:

 

Take time to read the Rental Agreement including the terms and conditions of the rental (conditions of service provision). Make sure you understand the applicable costs, the specifics of the guarantees, insurance and additional protective services included or not included in the rental cost, your obligations during the rental period, the cases and limits of your financial liability. If you have any doubts of any kind regarding the terms and conditions of your rental, you are obliged to ask for clarifications and explanations to AMA Rent A Car staff before signing the rental contract. Do not hesitate to ask questions to AMA Rent A Car staff about current promotional offers, in particular regarding cost or additional services.

Read and inform yourself about:

  • fuel tax arrangements
  • in case of return of the vehicle without full tank;
  • in the case of the Pre-Plated Fuel option;
  • the amount of the damage charge for the motor vehicle for which you are liable;
  • replacement value of vehicle accessories (including keys and documents) and equipment

 

1.4.b. Condition of the Vehicle

 

Your rental contract specifies any visible damage to the Vehicle, the number of kilometres on board and the level of fuel supplied at the time of rental.

When taking over the vehicle:

Check that the condition of the vehicle corresponds to that described in the rental documents . In case you notice any visible damage or any other damage that was not mentioned in the Rental Contract, you undertake to request AMA Rent A Car staff to rectify the information on the Vehicle Condition. Otherwise, AMA Rent A Car will not consider subsequent claims of visible damage and/or damage as justified.

Check and compare the mileage and fuel level on the dashboard with the information specified in the rental documents. You undertake that, in case of discrepancies, you will ask Avis staff to rectify the Rental Agreement.

Check if the registration certificate, the MTPL insurance policy and the amicable settlement form are in the vehicle. Check if the safety kit is complete (in the boot: two warning triangles, a fire extinguisher, a medical first aid kit; in the passenger compartment: reflective vest). If they are missing, ask AMA Rent A Car staff to provide you with the missing items.

1.5. During the rental period

 

 

  • Territorial validity

 

It is not allowed to drive/relocate the vehicle outside the Romanian borders without written authorization from AMA Rent A Car and payment of the appropriate supplements. AMA Rent A Car vehicles (except groups H, O, P, M and L) can only travel in the following European countries: Austria, Belgium, Bulgaria, Croatia*, Czech Republic, France*, Germany, Greece*, Hungary, Italy*, Luxembourg, Netherlands, Poland, Slovakia, Slovenia.

*On the mainland side only, passage to the islands is prohibited.

Border crossing supplement: if you intend to travel outside the Romanian territory you will pay a supplement of a fixed amount between 30 EUR and 990EUR and a daily border crossing fee of 5 Euro/day, according to the valid offers and tariffs applicable at the time of application, depending on the available car group, the declared countries and/or the specific period of rental.

IMPORTANT!

If we find that you have violated the conditions regarding the territorial validity of the rental, you will pay a penalty equal to the maximum applicable border crossing supplement (990 EUR). In case of damage to the vehicle and/or damage to a third party* occurring outside the territory of Romania or the territory authorized by express agreement of AMA Rent A Car, any insurance and additional protection services that may have been taken out are inapplicable. Your financial responsibility will be engaged for all attributable damages as well as any damage caused to a third party* (*The driver of the vehicle is not considered to be a third party).

 

1.5.b. Driving the vehicle

 

You undertake to take care of your vehicle and to use it in a normal and prudent manner, in compliance with the road traffic laws of the country where you are driving, for legal purposes. You undertake to refuel correctly, to lock the vehicle when not in use, to comply with all safety instructions, to notify us immediately of any event in which you have an obligation to inform us and to comply with the instructions given to you when you take over the vehicle.

Abnormal use of the vehicle: any illegal, dangerous or grossly negligent conduct during the period of the vehicle's entrustment

In particular, they are considered abnormal uses of the vehicle:

 Misfuelling, clutch failure due to incorrect operation, continued use of the vehicle despite alarm or fault signals appearing on the vehicle's dashboard;

 Driving of the vehicle by any person not mentioned in the Rental Contract and/or by a person mentioned in the contract in respect of whom the measure of suspension, cancellation or withholding of the licence has been taken after the date of the vehicle's surrender;

 Leaving the territory of Romania without the written consent of the rental station;

 Ignoring road signs and light and/or sound signals at railway level crossings;

 The use of a motor vehicle by a person who is under the influence of alcoholic beverages, narcotic products or substances or drugs with similar effects, or who has evaded or refused to take biological or toxicological samples or has left the scene of the accident, in situations where this is not permitted by legal regulations;

 Careless, reckless or excessive speed driving, violation of traffic rules, especially those related to red light running, failure to observe the Stop/Crossing sign and the railroad crossing sign, driving on the wrong side of the road or on one-way road sections marked in the opposite direction, use of a mobile phone or any other device that may distract the driver's attention (except hands free devices), failure to obey ambulance and police signals;

 Use of the vehicle in areas or on roads not included in the public road network, on unpaved roads, on sections of road or in areas forbidden to motor vehicle traffic, on roads presenting an increased risk of damage to the vehicle or as a result of entering areas with restrictions on the size and tonnage;

 Use of the vehicle in riverbeds or flooded or waterlogged areas (on or off the road) without following the manufacturer's instructions for use in such conditions;

 Mounting equipment on the outside of the vehicle, which may cause damage to the vehicle (e.g. flag carriers, bicycle racks, stickers, etc.); Using the vehicle for purposes other than those established by the manufacturer or by the road or civil legislation in force;

 Use of the motor vehicle to transport flammable, explosive, corrosive, oxidising, toxic, radioactive, noxious, hazardous or illegal materials;

 Pushing or towing trailers or other motor vehicles;

 Use of the vehicle for any type of racing or competition (including training), rallies, speed and endurance tests, including those outside an official programme;

 Selling, removing or replacing parts of the vehicle or additional equipment and allowing others to carry out these actions;

 Use of the vehicle for taxi driving, driving school, sub-leasing; Voluntary destruction or degradation of the vehicle;

 The use of a motor vehicle by a person who, at the time of the road traffic event, commits an offence with intent or attempts to evade prosecution following the commission of such an offence;

IMPORTANT!

The above examples are not exhaustive. Any unlawful, dangerous or grossly negligent conduct during the period of the vehicle hire will be considered a breach of contract and any additional insurance and/or protective services taken out will become inapplicable. You will be held financially liable for all attributable damages as well as any damage caused to a third party*. (*The driver of the vehicle is not considered to be a third party.)

 

 

 

1.5.c. Safety

 

During the rental period you will be hired:

To respect the safety conditions set by the manufacturer , in particular the maximum capacity specific to each vehicle with regard to the number of occupants and/or the weight of luggage or goods carried ("payload").

Check the condition of the vehicle (coolant level, oil level in the engine after 1000 km, tyre pressure).

Respect any signal emitted by the dashboard indicators of the vehicle and take the necessary measures if necessary (especially emergency stop).

Immediately notify the Roadside Assistance Service on the warning lights illuminated in the vehicle's dashboard or for any technical faults/defects and follow the instructions given.

During stationary, lock the vehicle and put all your personal belongings in the boot. Loss and/or theft of your belongings left in the vehicle is not covered by any additional protection product.

Make sure that you always have your keys and vehicle documents with you . Loss and/or theft of vehicle keys and documents is not covered by any additional protection product. Theft of keys and/or documents with the vehicle is an exclusion case for the Theft Protection Supplement (TPC) service. IMPORTANT!

Failure to comply with the safety conditions during the period of the vehicle's hire will be considered a breach of contract and any additional insurance and/or protection services that may have been taken out will become inapplicable. You will be held financially liable for all attributable damages as well as any damage caused to a third party* (*The driver of the vehicle is not considered to be a third party.)

 

1.5.d. In case of technical failure

 

In the event of a technical fault requiring immediate or rapid intervention, before carrying out any repair (including tyres), Contact AMA Rent A Car Assistance la:

1.5.e. In the event of a traffic accident or other circumstances leading to damage to the vehicle

 

 

Traffic accident : The event that cumulatively meets the following conditions: (i) occurred on a road open to public traffic or originated from such a place; (ii) resulted in death, injury to one or more persons or damage to at least one vehicle or other property damage; (iii) at least one moving vehicle was involved in the event (legal definition according to art. 75 of the Highway Code OUG 195/2002).

Other circumstances : any other situation in which the vehicle is damaged (e.g. hitting an animal, impact of foreign objects, weather phenomena, vandalism, etc.), except in cases of force majeure.

In case of a traffic accident or other circumstances you have the following obligations:

Report within 24 hours from the date of the traffic accident or from the date of the discovery of any other circumstance that resulted in the damage of the vehicle to the police unit of the locality where the event took place in order to draw up the documents of ascertainment.

Obtain all necessary documents before returning the vehicle (including if the vehicle has suffered a breakdown while being driven by an additional or unauthorised driver):

 If the damage to the vehicle is caused by a traffic accident with unknown perpetrator or in other circumstances (hitting an animal, impact of foreign objects, weather phenomena, vandalism, etc.): Report and/or Repair Authorization issued by the Police (original);

 If the damage to the vehicle is caused by a traffic accident with known perpetrator: Official report and repair authorization issued by the Police (originals) and copies of the following documents of the guilty driver: RCA, registration certificate, identity card, driving license;

 In case of amicable settlement (if 2 cars were involved in the accident, no injuries or fatalities resulted and both drivers agree and opt for this form of finding): fill in correctly and completely the form of Amicable Settlement (an original copy is retained) and together with the other driver involved go to the nearest settlement office of the insurer and obtain the repair authorization issued by the insurer of one of the two vehicles involved together with all the necessary documents, i.e. copies of the following documents of the driver at fault: RCA, registration certificate, identity card, driving license;

Submit the necessary documents to AMA Rent A Car as soon as possible, but no later than the return of the vehicle (including if the vehicle has suffered a breakdown while being driven by an additional or unauthorised driver).

Respond to any AMA Rent A Car request and provide any necessary documents or statements within 14 days, if these were not provided when the vehicle was returned, are incomplete or incorrect, if such omission or error prevents or delays the vehicle from being repaired or/and commercially operated. Otherwise, we reserve the right to hold you liable for other damages caused, including lost profit.

In case of vehicle damage requiring immediate or rapid intervention Before making any repairs (including tires), contact AMA Rent A Car Assistance at:

Do not repair the vehicle and do not allow anyone else to do so unless AMA Rent A Car has agreed to it. If you allow repairs to be carried out without AMA Rent A Car's consent, you will have to pay for it and you will lose the protection offered by AMA Rent A Car products.

In the case of vehicle damage not requiring immediate repair , regardless of the cause, you must inform the AMA Rent A Car office immediately.

In the event of a traffic accident, you do not assume responsibility for its occurrence towards any third party, otherwise, recovery and reimbursement of costs incurred to the maximum contractual liability will be difficult . If possible, retain the names and addresses of all persons involved, including witnesses and passengers. If the vehicle is no longer safe to drive, undertake to secure it in its current state and contact AMA Rent A Car Assistance to take it back.

In all cases, The contract holder or additional driver must complete the internal form fully and correctly. Driver Declaration about the circumstances in which the damage or damage to the vehicle occurred and to send it to the rental station within 48 hours of the event.

In all cases, The contract holder must obtain and deliver all necessary documents as instructed or requested by AMA Rent A Car.

Otherwise, any additional insurance and protection services that may have been taken out are inapplicable.

 

Your financial liability will be engaged for all damages attributable to cover damages to the supplier of services as well as of the damage possibly caused to a third party* (* The driver of the motor vehicle is not considered to be a third party.)

 

 

1.5.f. In case of theft

 

In case of theft/attempted theft of the vehicle, its parts, key and/or documents, you have the following obligations:

Report within 4 hours from the moment you became aware of the theft or attempted theft at the police unit in the locality where the event took place, file a theft/attempted theft report and submit a full statement of the circumstances of the event and a complete list of the goods stolen with the vehicle (including the key or documents, if they were stolen with the vehicle or in other circumstances), a list of missing equipment or components (if the theft concerned only parts of the vehicle) or, if applicable, of equipment or components destroyed/damaged as a result of attempted theft of the vehicle.

Delivered within 48 hours the nearest AMA Rent A Car rental office the report of the complaint, the key of the vehicle and its documents.

IMPORTANT!

The theft or loss of the key and/or vehicle documents is not covered by any additional protection service. Theft of the key and/or vehicle documents together with the vehicle is grounds for exclusion from the additional protection service in the event of theft of the vehicle.

In all cases, the Contract Holder must obtain and deliver all necessary documents as instructed or requested by AMA Rent A Car. Otherwise, any supplementary insurance and additional protection services that may have been taken out are inapplicable. Your financial responsibility will be engaged for all damages attributable to cover damages to the service provider as well as any damage caused to a third party* (*The driver of the vehicle is not considered a third party.)

 

1.5.g. Offences. Fines. Administrative fees

 

 

In accordance with the legislation in force you are responsible for any offence committed with the vehicle during the rental period, including all financial consequences. You are therefore informed that your data may be made available to the competent authorities upon request. You undertake to comply with the rules regarding traffic on public roads, to pay parking fees, to pay the Fetesti - Cernavoda bridge toll or any road, toll and/or parking fees valid at the time of your journey.

Offences: violation of traffic rules as well as any other situation of non-compliance with legal obligations in relation to parking, parking and moving the vehicle and/or with the payment of mandatory taxes or tariffs during the rental period (tolls, bridge crossing, parking fees, parking fees, fees for using public roads outside Romania, etc.).

Fines: any amount payable as a result of a finding that an offence has been committed during the period of tenancy, as required by the notices

payment received by AMA Rent A Car from the competent authorities.

Administrative fees: fees charged by AMA Rent A Car representing the cost of administrative procedures in connection with the transmission of information to the competent authorities and/or payment, where applicable, of fines imposed in connection with offences during the rental period. In some cases At the request of the competent authorities and in accordance with the law, for non-compliance with traffic regulations (in most cases exceeding the legal speed limit or parking in a prohibited area) AMA Rent A Car communicates the data to the contract holder in order to draw up an offence report on your behalf and apply the sanction or fine. In all these cases, AMA Rent A Car will charge an administrative fee of 35 EUR for each offence. In all other cases, respectively in case of non-payment of any other amounts due by you according to the legislation in force, both on the territory of Romania and in other countries such as tolls, bridge crossing fees, parking fees in airports or special spaces with limited duration, fines for traffic offences detected and/or proven by technical means (cases of objective liability for payment by the legal owner of the vehicle) as well as when the transmission of your data is not made in accordance with the legislation in force. to the competent authority that imposed the fine is not obligatory/not allowed by law, AMA Rent A Car will invoice the customer the actual amount of the fine plus an administrative fee of 35 EUR/ fine.

IMPORTANT!

You will be notified up to 12 months after the return of the vehicle/termination of the contract of any act communicated to AMA Rent A Car issued by a competent authority with a view to applying a penalty and/or levying a fine for offences during your rental period. If you wish to contest the fine or penalty, you must communicate directly with the issuing authority to obtain a cancellation, refund or compensation. Unfortunately we cannot help you with your dispute. The Contract Holder agrees that the Administrative Fees and the countervalue of the fines will be charged by Avis on the eligible card used at the conclusion of the contract, at any time within 12 months of the return of the vehicle/closure of the contract, together with the e-mail notification of the contravention during the rental period and the related payment invoice. In case of refusal of payment or charge back on the eligible card and if you have not made the corresponding payments by another payment method within 30 days from the invoice date, we charge a penalty interest equal to the reference interest rate of the National Bank of Romania plus 4 percentage points, according to O.G. 13/2011 and we will initiate all legal steps to recover the amounts due by you by any means allowed by law. In such a situation you understand that you will also be responsible for bearing any other costs associated with the recovery of the debt (stamp duties, legal fees, enforcement costs).

 

 

 

1.6 Returning the Vehicle

 

  • General rules

 

Return the vehicle, its keys and documents to AMA Rent A Car staff at the date, time and location of the drop-off as set out in the Rental Contract. and in all cases during the working hours of AMA Rent A Car offices.

Inform AMA Rent A Car, as soon as possible, of any event (including in the case of self-bonding/mandatory self-registration following a positive test for COVID 19) that prevents you from returning the vehicle at the agreed date, time and location. otherwise you may be liable to prosecution for breach of trust or theft. AMA Rent A Car will file a criminal complaint for theft, in the absence of any communication from you, at the end of a period of 6 hours from the date and time of return of the vehicle set out in the rental contract. In case of objective impossibility of returning the Vehicle at the date, time and location agreed please contact the rental location or write to contact@ama-rentacar.ro cat as soon as possible. Please make sure that the rented car is parked in a safe, designated place where no fines will be applied. The rental contract remains open and you owe additional rental costs until the vehicle is returned to one of our rental stations. If you opt for pick-up by an AMA Rent A Car representative, pick-up fees will apply for locations where there are no AMA Rent A Car offices.

If you wish to extend the rental period, you must contact an AMA Rent A Car rental office 24 hours prior to your original pick-up time, to obtain the agreement to extend the lease and to ensure the necessary availability for the payment of the additional amounts generated by the extension of the contract.

If the vehicle is excessively dirty on the outside, AMA Rent A Car reserves the right not to process the termination of the rental contract if it is unable to identify any damage caused during the rental. The contract will be processed after the vehicle has been washed and checked, with the time of actual delivery of the vehicle to AMA Rent A Car.

In all cases of exceeding the date and time mentioned in the contract , you owe the rental fee, including additional rental costs, late return charges and possible damage charges incurred by the vehicle up to the time of return to AMA Rent A Car.

If you return the vehicle outside the rental office working hours and deposit the vehicle keys in the rental office's key box, you remain liable and owe the rental fee and any damages that may be due to you.

attributable (in particular those suffered by the vehicle) until the time of reopening the rental office and until the vehicle is checked by an AMA Rent A Car employee.

In case AMA Rent A Car accepts to hand over the vehicle to another rental office than the one mentioned in the contract, you will incur the applicable relocation fees.

If AMA Rent A Car agrees to travel to pick up the vehicle from a location other than the drop-off location under the contract , you are responsible for and owe the rental fee and any expenses related to damage to the vehicle until it is taken over by Avis as well as removal fees.

In all other cases in which the Vehicle, for any reason, is not delivered according to the provisions of the rental contract you owe in addition all costs related to parking the Vehicle in a paid public parking lot and/or any other fees or fines due for parking (abandoning) the Vehicle in prohibited spaces, up to the time of pick-up of the Vehicle by AMA Rent A Car representatives, plus all expenses related to the travel of AMA Rent A Car representatives from the nearest AMA Rent A Car rental office to the location of the Vehicle and any expenses related to the identification of the location of the Vehicle as well as an administrative fee of 25 Euro.

 

1.6.b. Returning the Vehicle to another rental office

 You can choose to return the vehicle to another rental office than the pick-up office, depending on the availability of the requested car. A reservation request is required. The request will be confirmed or refused within 72 hours. Obtain information from an AMA Rent A Car agent at the time of booking. This additional option must be taken at the beginning of the rental and indicated in the Rental Contract. If your rental rate does not include this option, the following displacement charges are applicable:

 In Romania : between cities where there are AMA Rent A Car rental offices, the fee for dislocation is between 0 and 400 EUR, according to the valid offers and rates applicable at the time of the request, depending on the location and the specific rental period.

 

1.6.c. Personal items left in the vehicle

 

Although we check the vehicle thoroughly upon return, we do not assume any responsibility for forgotten/left items. In case we find forgotten personal items, they will be picked up and inventoried by AMA Rent A Car staff at the return office. You can retrieve them personally or request, in writing, their delivery to the address indicated. In the latter case, you will pay in advance the cost of the delivery service via our partner courier company Avis or national post and a handling fee of 50 Euro.

ATTENTION : All personal items found and not claimed within a period of 3 (three) months will be destroyed.

 

 

 

1.6.d. Vehicle Condition Control

 

You have the obligation to check the condition of the vehicle with AMA Rent A Car staff when returning the rented vehicle and to compare it with the condition mentioned in the Rental Contract.

If the condition of the vehicle (including equipment or accessories) at the time of return differs from that at departure AMA Rent A Car will invoice the damages/damages or shortages found (with the exception of minor damages) respectively the fixed amount (penalty) established contractually for specific cases, within the limit of the maximum applicable financial liability (depending on the additional protection services possibly concluded at the pick-up of the car). AMA Rent A Car calculates the replacement or repair costs on the basis of the damage cost matrix according to the available values which can be presented at the rental office. In other situations (e.g.: the amount of damage is significant and cannot be calculated on the basis of the damage cost matrix) we will call upon authorised experts/repairers to draw up a payment estimate. Avis charges a fee of 30 EUR/damage file representing the cost of administrative procedures.

IMPORTANT!

If you refuse to participate in the inspection, if you decide not to carry out the inspection with AMA Rent A Car personnel at the time of the return of the vehicle or if, for any other reason, you do not participate in the inspection by an AMA Rent A Car representative at the time of the return of the vehicle, you entrust AMA Rent A Car with the task of carrying it out and you accept the findings made and the billing of the corresponding damages, if applicable.

 

1.7. Damage attributable

 

Damage attributable : are mainly the costs of repair or replacement of parts, equipment and accessories of the vehicle, up to the market value of the vehicle, to which may be added, as appropriate, costs related to transportation and immobilization, loss of use, administrative costs and any other direct and foreseeable losses suffered by the service provider as a result of damage and/or deterioration of the vehicle, until the vehicle is taken over by AMA Rent A Car staff. To calculate and charge as appropriate damage represented by the cost of repair and/or replacement of parts/equipment or accessories, Avis uses a matrix of deterioration costs carried out and regularly updated on the basis of the following indicators: average repair cost for the rented vehicle group (taking into account the different makes and models in the group); labour hours required to repair the vehicle; average cost of labour hours from accredited partner repairers; price of original parts to be replaced. The damage costs determined according to the damage cost matrix are due independently of our decision whether or not to repair the vehicle. Damage compensation based on the replacement cost list for certain accessories or equipment is due in all cases where these are missing or seriously damaged. . In the case of significant damage that cannot be calculated according to the valuation matrix we will contact an authorised surveyor/repairer to identify the damage and assess the necessary repair costs.

 

1.7.a. Strict liability

 

Your liability is strict (regardless of fault, except in cases of force majeure) and you undertake to pay the damages attributable to you as a result of damage and/or damage to the vehicle during the rental period, until the vehicle is picked up and checked by AMA Rent A Car staff. You authorize us to charge your eligible card with the corresponding amounts, up to the limit of your maximum financial liability, depending on the additional protection services included in the rate or for which you opted at the conclusion of the rental contract.

WARNING: Certain situations are not covered by any additional protection service if AMA Rent A Car charges the full cost of damaged or missing parts/equipment/accessories and related labor on the rental contract if: The vehicle is fuelled with another type of fuel than the one it uses. Situation not covered by any additional protection product . A fee/penalty of 1785.00 EUR will be charged on the rental contract for the replacement of all parts affected by misfuelling (e.g. injectors, exhaust gas catalyst, particulate filter, fuel filters, tank cleaning, fuel system cleaning, etc.).

Clutch assembly is damaged due to improper use . Situation not covered by any additional protection product.

The vehicle is damaged or damaged in circumstances other than a traffic accident as defined by law, respectively in situations such as extreme weather events, falling bodies from height, snow or snowdrifts, fires, floods, avalanches, vandalism, acts of terrorism, etc. Situation not covered by any additional protection product.

Damage to the engine, wheels (tyres, rims, wheel covers), interior of the vehicle and under the bodywork vehicle , if the damage is not the direct result of a traffic accident. Situation not covered by any additional protection product.

Damage resulting from theft or attempted theft of GPS/WIFI units/child seats or personal belongings from the vehicle. Situation not covered by any additional protection product.

Windscreen damage. Situation covered by the supplementary protection service in case of damage to the windscreen of the Motor Vehicle (LI) as a result of road events.

Damage to panoramic roof and rear-view mirrors . Situation covered by CDW (Collision Damage Waiwer) or SCDW (Super Cover) additional protection services EXCLUSIVELY for damage or damage from a traffic accident.

Theft of the vehicle and/or parts thereof . Situation covered by TPC (Theft Protection Coverage) or SCDW (Super Cover) additional protection services.

Theft or loss of the key or vehicle documents . Situation not covered by any additional protection product. Theft, loss or damage to vehicle registration plates. Situation not covered by any additional protection product.

Theft, loss or damage of additional equipment and accessories. Situation not covered by any product of additional protection.

Theft, loss or damage of security kit items. Situation not covered by any additional protection product.

 

IMPORTANT!

Any damage or damage sustained by the vehicle during the rental period, i.e. until the vehicle is picked up by AMA Rent A Car staff, will incur liability for the cost of repair or replacement of damaged parts and related labour up to the maximum limit of your financial liability. In the event of damage caused as a result of a traffic accident caused by the exclusive fault of an identified third party and if he or his insurer pays compensation, AMA Rent A Car shall refund to you all amounts thus received, to the extent of the corresponding payments made by you.

Additional insurance and/or protection services cover only the situations and risks expressly described and cannot be extended by analogy. If you are the beneficiary of an additional insurance/supplementary protection service, please read carefully item 2 - Additional Insurance and Protection Services.

 

 

 

1.7.b. Invoicing and payment in case of damage

 

You are obliged to pay the invoices issued by AMA Rent A Car corresponding to the amount of the damages ascertained by AMA Rent A Car staff at the time of return/collection* of the vehicle or later, if, for any reason, the damages could not be observed, ascertained and/or assessed at the time of return/collection of the vehicle. Non-payment or late payment of the amounts due according to the invoices issued for attributable damage, more than 30 days late, entitles us to charge a penalty interest equal to the reference interest rate of the National Bank of Romania plus 4 percentage points, according to O.G. 13/2011. Avis charges an administrative fee of 30 EUR/damage file.

(* Return refers to the situation in which you are present and participate in the Vehicle condition check in the presence of an AMA Rent A Car representative. Takeover , refers to all other situations where the Vehicle is checked and inspected in your absence, for whatever reason. ) In the case of visible damage found when returning/taking back the vehicle :

 if their value can be established (penalty and/or cost according to the damage cost matrix), the cost is included in your final invoice. The invoice is issued and usually sent to you on the spot or within 72 hours to the e-mail address indicated in the rental contract (if you are not present when returning the vehicle).

 if the damage is significant and cannot be calculated according to the damage matrix we will contact an authorised surveyor/repairer in order to identify the damage and assess the necessary repair costs and will send you the invoice for payment together with the survey documents and the estimated estimate as soon as possible to the e-mail address indicated in the rental agreement (depending on the period required for the assessment, but not more than 60 days).

In case of damage and/or deterioration that could not be observed and/or detected at the time of return/collection of the vehicle, we will send the detailed payment invoice, estimate/repair estimate (if applicable) any other necessary documents accompanied by proof that the damage occurred during the period the vehicle was entrusted to you, to the e-mail address indicated in the rental contract, within a maximum of 30 days.

IMPORTANT! Unless, at the time of return of the vehicle, you have accepted and signed the damage report document and the corresponding invoice, FOR ANY COST THAT WE INVOICE YOU FOR IMPUTABLE DAMAGES WE WILL PROVIDE YOU WITH ALL NECESSARY EVIDENCE:

 rental contract number, date and location of return, report on the condition of the vehicle on return, including all damage identified in your presence or absence, photographs of damage and/or other evidence of damage;

 explanations required when the amount of damage is calculated according to the damage cost matrix or on the basis of the list of replacement charges for certain accessories or equipment;

 valuation/estimates from the surveyor/authorised repairer and/or repair invoice in the case of damage that could not be assessed on the basis of the damage matrix;

 if applicable, driver's statement, minutes, repair authorisations or any official police findings and/or expert reports in case of traffic accident or other circumstances, on-site photographs of the damage and odometer;

 the amount of the excess, if the damage is covered by an additional protection service or, where applicable, the reason for the exclusion or inapplicability of the protection service.

 where applicable, transport and immobilisation costs, loss of use, administrative costs and any other direct and foreseeable losses incurred by the service provider as a result of damage and/or breakdown of the vehicle.

 

On the basis of the invoice and the proofs submitted and only after they have been communicated to you at the e-mail address indicated by you in the rental contract (or, in the absence of such address, at the home or mailing address indicated in the contract), you authorize us to debit your eligible card with the amounts due.

1.7.c. Appealing damages

 

You may dispute a damage bill in any situation where you can prove that the billing by AMA Rent A Car was not done in accordance with the terms and conditions of the respective rental contract if you believe that:

 the damage is not attributable to you under the contract;

 there is a case of exclusion or limitation of your financial liability and this case has not been considered by AMA Rent A Car;

 the damage was the sole fault of an identified third party and he or his insurer paid the damages;

 the damage is worth less than we have declared, as a result of a calculation error based on the damage matrix or any other serious error in the damage assessment report or estimate;

 any other situation that you can prove concerning the existence of the damage, the assessment or the imputed repair cost, if such situation results, in your opinion, in an obligation on our part to reimburse, reduce or offset the invoiced amounts.

In any case, it is important to formulate an objection and to present your arguments and proofs within 15 working days at the latest from the communication to you, via e-mail, of the invoice issued by AMA Rent A Car and the proofs we have provided you with the invoice, otherwise we will consider that you have unconditionally accepted the invoiced amounts. We will examine the arguments and evidence you have submitted and will send you our resolution within 15 working days. To the extent that we consider your complaint to be justified: we will reimburse the costs as chargeable damages (if we have already withdrawn the payment, as the law and the contract allow us to do so) or we will reimburse you the difference if you prove that the damages are worth less than we have declared. If the resolution given by us in relation to your claim is not satisfactory: you can apply to the European Car Rental Conciliation Service (ECRCS), another conciliation body or the competent courts in Bucharest, Romania.

IMPORTANT!

Your complaints and the deadlines for resolving them do not suspend the obligation to pay the invoice issued under the contract, even if you have addressed the conciliation bodies or competent courts. In cases where we have not already withdrawn amounts from your eligible card, upon the expiry of a period of 30 days from the date on which we sent you the invoice we will start to calculate penalty interest for each day of delay in accordance with the law, until the invoice and the corresponding interest have been paid in full. In case of refusal of payment or charge back on the eligible card and if you have not made the appropriate payments by another payment method (including if a third party or its insurer makes the payment) within 4 months from the invoice date we will initiate all legal steps to recover the amounts due by you by any means permitted by law. In such a situation you understand that you will also be responsible for bearing any other costs associated with the recovery of the debt (stamp duty, legal fees, enforcement costs).

 

 

 

1.8. Rental cost

  • Basic rate/rent rate. Estimated cost

 

Basic tariff is the rental fee for a vehicle (without additional equipment, options or services) due for one rental day (24h) and/or per km, corresponding to the group of the rented vehicle, valid in relation to you according to the tariffs in force at the date of reservation, rental or modification of the reservation or rental conditions, as the case may be.

The basic fee includes :

 third party liability insurance;

 vignette valid on the territory of Romania (does not cover special bridge fees, where applicable);

 24/7 technical assistance for the vehicle.* This assistance includes the repair or transportation of the Vehicle and/or the provision of a replacement Vehicle (subject to availability, exclusively on the territory of Romania) in case of immobilisation on a road open to public traffic, following a traffic accident, technical breakdown or fire. Technical assistance is not included in the event of immobilisation due to loss of the vehicle keys, locking the vehicle with the keys inside, battery discharge due to carelessness in use, misfuelling, damage to the clutch, damage to the tyres or rims, immobilisation due to water suction in the engine, in the event of a road traffic accident caused solely by your fault or in the event of abnormal use of the vehicle, Chapter 1.5. b.

* AMA Rent A Car is obliged to replace the vehicle (subject to availability), if the damage/defect is not the fault of the customer, within 24 hours, depending on the location where the defect was detected. If the damage/defect is the fault of the customer, a new warranty will be requested for the replacement vehicle. We reserve the right to refuse to supply a replacement vehicle if the breakdown is the result of a proven case of abnormal use of the vehicle.

The rental fee. To the basic rate may be added, where appropriate:

 cost of fuel used, in accordance with Chapter 1.6.d. Fuel;

 the cost of other optional extras, equipment and services mentioned below;

 the cost of insurance and additional protection services, provided at your request and/or agreed by signing the rental contract;

The rental fee is calculated in 24-hour intervals, starting from the time of the start of the rental contract processing and ending with the processing of the closure of the Rental Contract. AMA Rent A Car accepts a maximum delay of 29 minutes for the return of the vehicle, admitting that this time is necessary for the pick-up and return of the vehicle. Once this period is exceeded, AMA Rent A Car will invoice an additional day of rental, as well as the charges for the chosen options, for each day of delay.

IMPORTANT!

Estimated cost of the rental is the amount indicated in the rental contract, calculated on the basis of the rental rates applicable at the time of reservation or request for services (for rentals without prior reservation), in accordance with your options regarding car group, rental period, rental location, applicable supplements, price of additional equipment and services, additional options, insurance and additional protection services included in the rate or offered at your express request. The cost is "estimated" because it excludes any costs due for fuel as well as any other amounts that may be due by you as a result of using the vehicle during the rental period.

A confirmed reservation indicate the total price of the booking calculated on the basis of the rates and offers available on the booking channel of your choice (direct booking, through travel agency, dedicated websites, etc.).

When taking over the vehicle : any changes to the rental conditions mentioned in the booking or requests for additional services and/or equipment may result in additional costs.

When handing over the vehicle: the cost of the rental may be increased by taxes, charges, penalties, damages attributable to you as a result of the use of the vehicle. Certain costs, fees or charges may be levied by AMA Rent A Car after the vehicle has been handed over if we have become aware of the fact causing the damage and/or the amount of the damage has become certain after the vehicle has been handed over. Rates that include reduced or zero liability in the event of a traffic accident or theft of the vehicle do not include reduced or zero liability for damage not covered by any additional protection product.

Because special offers and discounts often relate to certain time periods, if you take back the vehicle earlier or return the vehicle earlier or later than agreed at the opening of the contract, it is possible that the special rate originally agreed may no longer apply, resulting in an increase in the rate. The number of kilometres driven during the Rental Contract is the one indicated by the vehicle odometer. In case of odometer failure caused by fraudulent actions and if the rental rate includes a limited mileage, AMA Rent A Car will charge 1000 km per rental day at the current rate.

1.8.b. Supplement

 

AMA Rent A Car charges certain additional expenses and these will be included in the rental rate, only after prior notification, to the extent that they are applicable in the relationship with you:

Participation in Registration Costs (VLF) - supplement included in the rate at the time of rental/booking, amounting to 4

EUR/day, as a contribution to the costs of registering the vehicle;

Supplement for vehicle pick-up from an airport / premium location - supplement included in the rental rate at the time of rental/booking in the flat rate of 15% of the estimated rental cost;

Young Driver Supplement - 7 EUR/day rental (maximum 10 chargeable days) for drivers over 21 and up to 25 years old;

Supplement Driver under 21 years - 45 EUR/day rental for drivers over 18 and up to 21 years old; Beginner Driver Supplement - 45 EUR/day rental (if driving experience is less than 1 year); Senior Leader Supplement - additional fee of EUR 7/day (maximum 10 chargeable days) for persons over 70 years of age;

Border Crossing Supplement - an additional fee of 30-990 EUR, applied in case of travel outside the territory of Romania and a daily border crossing fee of 5 Euro/day;

Additional Driver Supplement - additional fee of 7 EUR/day, maximum 10 days/additional driver;

1.8.c. Out-of-hours rentals

 

At certain rental offices it is possible to pick up or return the vehicle outside of business hours and be assisted by an AMA Rent A Car agent. In this case a fee of 50 EUR will be charged. Please check this possibility at the AMA Rent A Car office in your area or at the Reservations department.

 

1.8.d. Optional equipment and services for Motor vehicles

 

For your comfort and safety, AMA Rent A Car provides you with optional equipment and services in exchange for the payment of the appropriate rates. Ask the AMA Rent A Car agent to show you the available equipment* and optional services if you have not opted for them at the time of booking.

*Some equipment may not be available at the point of rental.

The rental rates/day are those indicated in the reservation request or at the time of rental if the equipment or services requested are not subject to the reservation. Before opting for an additional equipment or service, you should inform yourself about the valid rates, the costs of replacement equipment in case of loss/theft or damage, the terms and conditions of the optional services. Obtain information from your AMA Rent A Car rental agent at the time of rental.

*In Romania, children up to 135 cm in height may be transported in vehicles equipped with driver and passenger safety systems only if they are secured or restrained by a child seat restraint installed in the vehicle.

 

Deliveries/purchases of motor vehicles in Romania. The service is on request and depends on the availability of the AMA Rent A Car office staff and the method of payment. Delivery and pick-up requests must be sent at least 24 hours in advance. Vehicles can be delivered during business hours from the nearest AMA Rent A Car rental office, if you have provided proof of meeting the rental conditions at the time of booking. In cities where there are AMA Rent A Car offices, delivery and pick-up of the vehicle is free of charge to/from any address within the city limits. In cities where there are no AMA Rent A Car offices, delivery and pick-up of the vehicle will be made for a fee of 1 EUR/km (minimum 30 EUR) to/from the nearest AMA Rent A Car office.

1.8.e. Loss/damage of accessories, documents and optional equipment

Security kit: in case of loss (including theft) or serious damage of the components of the security kit we apply a fixed fee of 40 EURO on the rental contract.

Optional equipment : you will be invoiced and responsible for paying the replacement value in case of loss (including theft) or serious damage. Replacement values for optional equipment are available and can be presented at the rental desk.

Chei: you will be invoiced and responsible for paying the replacement value in case of loss (including theft). Replacement key values are available and can be presented at the rental desk.

Documents and registration plates: you will be invoiced and responsible for paying the replacement value in case of loss (including theft or serious damage). Replacement values are available and can be presented at the rental office. If you fail or refuse to provide the necessary documents and/or declarations, we may additionally charge compensation equivalent to the damage suffered by AMA Rent A Car during the period in which the vehicle cannot be used for commercial purposes (until duplicate documents and new registration plates are obtained).

1.8.f. Vehicle thorough cleaning fee

 

AMA Rent A Car applies an additional fee of 100 EUR if professional cleaning of the vehicle is required when returning the vehicle.

1.8.g. Smoking tax

 

Smoking is prohibited in all AMA Rent A Car vehicles. AMA Rent A Car charges an additional fee of EUR 100 if the vehicle is returned with tobacco smell or residue.

 

1.8.h. Final cost

 

Anything not expressly included in the estimated rental cost, i.e. any amount not paid by the Client at the end of the Contract representing damages/costs/fees/penalties attributable to him as a result of the use of the vehicle during the rental period will be subject to a separate invoice, in particular:

 24/7 technical assistance for the vehicle in cases of immobilisation not covered by the technical assistance included free of charge and expressly in the basic rate.

 loss or theft of the vehicle, keys, vehicle documents, security kit, other equipment and accessories. loss and/or damage of registration plates.

 damages attributable in case of damage or breakdown of the vehicle during the rental period.

 Fines (traffic, parking, bridge crossings, etc.) and administrative fees related to processing and paying fines, as applicable.

 smoking tax, professional vehicle cleaning tax, any other tax or penalty expressly provided for and due in the event of the discovery of one of the situations that entails the payment of the tax and or penalty in question.

Any chargeable damage, fee or penalty expressed in a fixed amount shall be applied and charged by us on the rental contract when it is established in your presence and/or proven by any means, including photographs or witnesses, that during the rental and/or at the date of handover of the vehicle there is a case/situation which entails your financial liability in a fixed and determined amount. Certain costs may not be determinable upon return of the vehicle, in particular those related to significant damage or fines in connection with your rental. In the latter case you will be notified and invoiced as soon as these costs are identified.

2. INSURANCE AND SUPPLEMENTARY PROTECTION SERVICES

 

Avis offers you additional insurance and protection services designed to cover specific risks or, where appropriate, to reduce or exclude your financial liability in the event of attributable damage.

Read carefully the specific terms and conditions insurance and additional protection services, in all cases where these are included in your rental rate or you have opted for them at the time of booking or rental.

Pay attention and make sure you understand which risks are covered, what are the maximum limits of your financial liability in case of a covered risk and what are the exclusion situations.

Request further explanation to the rental agent if you need any clarification.

Insurance and additional protection services are not valid outside the territory of Romania without written authorization from AMA Rent A Car and payment of the corresponding supplements. Insurance and additional protection services outside Romania are subject to special conditions and rates.

Any additional insurance and/or protective services not included in the rental rate are presented and offered to you exclusively at your request.

 

2.1. Validity of insurance and supplementary protection services

 

WARNING: unless otherwise expressly specified, insurance and/or supplementary protection services are applicable only in the case of damage arising from a traffic accident as defined by law. (see point. 1.5.e - In case of accident In case of non-compliance with the terms and conditions of hire, in particular with regard to the duration of the hire, the normal and prudent use of the vehicle (see the example list of abnormal uses in point 1.5.b.), the territorial validity (point 1.5.b.), the territorial validity (point 1.5.c.) and the duration of the hire (point 1.5.d.)..5.a.), authorised drivers (point 1.1.), procedure in case of accident or theft and necessary documents (points 1.5.e. and 1.5.f.) insurance and additional protection services are not applicable.

  • Third party liability insurance (RCA)

 

The RCA is mandatory by law and is included in the rental rate . Third Party Liability (TPL) insurance protects you from the financial consequences of bodily injury and/or other property damage that the licensed driver of the vehicle may cause to third parties as a result of a traffic accident. RCA excludes :

bodily injury to the driver and/or passengers of the vehicle (especially in the event of an accident);

damage to/theft of the vehicle;

damage caused to goods, objects and animals transported in the vehicle;

 

2.3. Additional protection services

 

By taking out additional protection services, reduce the amount of the maximum financial liability (called Liability) applicable in case of damage(s) caused to the vehicle or in case of theft of the vehicle up to a maximum value specified in the rental contract (rom. "fransiza" , engl. "excess." ). In the absence of the conclusion of these additional protection services, you shall be liable for damages attributable to you to the extent of the Liability without the conclusion of the additional protection service.

2.3.a. Collision Damage Waiver (CDW)

 

CDW protection: in the event of damage to the motor vehicle as a result of a traffic accident, reduction of the financial liability of the Policyholder to the amount of the reduced liability (" fransiza"/"excess" ) specified in the rental contract (see definition of traffic accident in 1.5.e).

CDW application conditions : This additional protection service must be concluded at the beginning of the rental and indicated in the Rental Contract.

Exclusions : The Policyholder is liable for full payment of the damage up to the full value of the vehicle, plus any expenses and costs related to the transport and immobilisation of the vehicle, other foreseeable losses and/or any damage caused to a third party, if the damage occurred in any of the following circumstances:

 abnormal use of the motor vehicle (see example list in point 1.5.b.);

 the vehicle was driven at the time of the damage by a driver not authorised by Avis.

 the damage occurred after the date and time of delivery of the vehicle indicated in the rental contract. the damage occurred in a location outside the territorial validity limits.

 the damage occurred in other circumstances (other than a traffic accident as defined by law);

 damage to the windscreen and glass surfaces, damage to the interior of the car, damage to the panoramic roof and rear-view mirrors, and damage to the underbody of the vehicle if not the result of a road traffic accident.

WARNING: in case of damage to the vehicle as a result of a traffic accident, you must proceed according to point. 1.4.e. - In case of accident. Otherwise, CDW is not applicable.

2.3.b. Theft Protection Coverage (TPC)

 

TPC protection : in case of theft of the motor vehicle, reduction of the amount of the maximum financial liability (Liability) applicable in case of theft of the motor vehicle to the amount of the reduced liability (" fransiza"/"excess" ) indicated in the rental contract.

Conditions of application of the CPC : This additional protection service must be concluded at the beginning of the rental and indicated in the Rental Contract.

Exclusions : The Contract Holder is responsible for the full payment of the maximum financial liability (Liability) applicable in case of theft of the vehicle, if you do not hand over within 48 hours from the date of the theft: the report of the complaint, the key of the vehicle and its documents.

WARNING: in case of theft of the vehicle you must proceed according to pct. 1.5.f. - In case of theft .

 

2.3.c. Protection in case of damage to the windscreen of the vehicle (LI)

 

LI protection : in the event of damage to the windscreen (scratches, chipping, breakage) as a result of a road accident, reduction of the financial liability of the Policyholder to 0 (zero).

Application conditions LI : This additional supplementary protection service must be concluded at the beginning of the rental and indicated in the Rental Contract.

Exclusions : LI does not reduce your financial liability in respect of other damage to the vehicle (in particular the panoramic sunroof and rear-view mirrors) or theft of the vehicle, for which you are liable in any event. LI does not apply in the case of damage to the windscreen caused off public roads and/or other situations which are not the direct result of driving under normal conditions on a public road (e.g. damage to the windscreen during parking or parking, hail, falling objects from a height, avalanches, fire, vandalism, etc.).

3. GENERAL CONDITIONS

 

  • Privacy policy and personal data

 

AMA Rent A Car collects and processes your personal data in accordance with the provisions of EU Regulation No 679/2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and any other applicable European or national regulations. The collection and processing of your data is done in accordance with terms of the privacy policy - information note on personal data protection published on the AMA Rent A Car website. In this section when we say "you" we mean: (i) the contract holder; (ii) additional drivers; (iii) any persons making payments for the rental.

By signing the Rental Agreement, you declare that you have read, understood and accepted the privacy policy and grant us explicit permission to use your personal information to the extent permitted by law.

Purposes of processing personal data:

Car rental services (registration of the rental reservation, conclusion of the rental contract, assistance services during the rental contract, issuance of fiscal documents);

To carry out relevant checks on identity, safety, driving licence and financial status; To maintain and improve the administration and management of our services;

To send you information about similar goods and services that we think you may be interested in, if the law allows us to do so. You may choose not to receive such information at any time by contacting the Customer Relations Department or by clicking the unsubscribe button in the email you receive;

For detection and prevention of crime as well as for security reasons of our vehicles we may use electronic devices (GPS technology) that can monitor vehicle status, efficiency and operation as well as vehicle movements. This information may be used during the rental period and at any time thereafter if it is relevant to your obligations during the rental period and if the law allows us to do so.

Certain vehicles in the AMA Rent A Car fleet have been manufactured or have been specially equipped with devices on board that allow the vehicle to connect to the internet ( connected car This allows us to transmit commands and receive certain information from the vehicle, including GPS geolocation. If you are offered and agree to rent a connected vehicle ( connected car ) personal data are processed in accordance with the Privacy Policy and Information Notice on the Protection of Personal Data in Connected Vehicles ( connected cars privacy addendum );

Compliance with legal obligations;

Marketing/promotion/evaluation of the quality of AMA Rent A Car services (including by sending newsletter/sms messages); Complaints resolution;

Issuance of insurance certificates/settlement of damage files; Issuance of powers of attorney for border crossing;

Issuance of letters of disbursement of pre-authorized amounts to banking entities.

Legal basis for the collection and processing of data of the data subjects for each of the purposes defined above may be: the legitimate interest of AMA Rent A Car; the Rental Agreement to which the data subject is a party; the consent of the data subject; a legal obligation.

Recipients of personal data. In the processing and storage flow, personal data could be transferred to the following categories of recipients, as necessary: State authorities (including tax authorities); Providers directly/indirectly involved in the rental process (e.g. IT service providers, billing service providers, marketing service providers, newsletter, customer satisfaction evaluation); Insurance companies; Car leasing companies; Banking institutions issuing payment instruments used by the data subject;

Data storage period. Personal data will be kept for a period of time provided for by specific legal provisions and as long as they remain necessary for the purposes mentioned above.

Rights of data subjects. Data subjects whose personal data are collected by AMA Rent A Car have the following rights under the relevant legislation: The right to request AMA Rent A Car, with regard to personal data relating to the data subject, access to, rectification or erasure of personal data or restriction of processing or the right to object to processing, as well as the right to data portability; The right to withdraw consent at any time, without affecting the lawfulness of the processing carried out on the basis of consent prior to the withdrawal of consent; The right to lodge a complaint with the National Supervisory Authority for Personal Data Processing.

3.2. Extension, termination and cancellation of the rental contract

 

The terms of extension or early termination of the rental contract can only be determined with the agreement of AMA Rent A Car. The intention to extend the rental contract shall be communicated to AMA Rent A Car at least 24 hours before the expiry of the contract.

The contract shall terminate automatically at the end of the rental period or before the initial contractual term, by agreement of the parties or as a result of unilateral termination if one of the parties fails to perform or improperly performs its essential contractual obligations.

Termination of the Contract is effective as of right, without court intervention, without delay or completion of any additional formalities from the moment of sending the notice of termination by any of the following means: by phone (SMS or any other form of electronic messaging of the if to contact numbers provided at the conclusion of the contract); electronic mail from and to the email addresses provided at the conclusion of the contract; postal or courier transmissions at the addresses indicated at the conclusion of the contract.

If the lessee is a legal entity under specific agreements, the notice of termination shall be sent to both

the contract holder and the legal person.

Both in the event of termination of the Rental Contract before its expiry date and in the event of termination, the Contract Holder is obliged to return the vehicle within 12 hours from the moment of termination by agreement of the parties or from the moment of sending the notice of termination. Otherwise you are responsible for all actions, costs, claims and damages arising from the repossession of the car by AMA Rent A Car.

Regardless of the time or cause of termination, you are liable to AMA Rent A Car for all attributable damages and financial consequences in connection with the use of the vehicle during the rental period. In the event of termination due to AMA Rent A Car's failure to comply with an essential obligation, AMA Rent A Car's liability is limited to the amount of the estimated cost of the rental.

3.3 Jurisdiction clause. Litigation.

 

Any dispute arising out of the Rental Agreement which could not be resolved by agreement of the parties or as a result of a resolution issued by a conciliation body shall be settled by the competent courts in Bucharest, Romania.

On the basis of the rental contract signed by you and the invoices issued, AMA Rent A Car will initiate court proceedings to obtain an enforceable title, by means of simplified payment order procedures or, where applicable, ordinary law procedures, in all cases where more than 4 months have passed since the due date of the invoice, or may entrust the pursuit, collection and, where applicable, enforcement of the amounts due to legal entities specialising in debt recovery. In all cases you will also be responsible for bearing any other costs associated with the recovery of the debt (stamp duty, lawyers' fees, enforcement costs).

Contractual liability

 

The contract holder exercises legal security for the vehicle and, subject to express contractual clauses/insurance/additional protection services regarding limitation or exemption from financial liability, your liability is engaged in all situations except in cases of force majeure.

The Contract Holder is responsible for the full compliance with all his contractual obligations as well as for the payment of all invoices issued under the contract and authorizes AMA Rent A Car to withhold, follow up and collect any amounts due under the invoices issued from the eligible card used at the conclusion of the rental contract, if the amounts due have not been paid by another means of payment.

In case of late non-payment/payment, unjustified refusal of payment, lack or withdrawal of funds required on the eligible card for the payment of invoices issued under the contract, the contract holder owes late payment penalties equal to the B.N.R. reference interest rate plus four percentage points, until full recovery of the amount due.

The Contract Holder understands that, even if the contract payer is a legal entity, its liability is personal in respect of compliance with the terms and conditions of the lease and joint and several in respect of any payment obligation under the lease. In this case, AMA Rent A Car may proceed to pursue and collect any amounts due from the Contract Holder and/or the legal entity, at its discretion.

 

3.5 Convention on evidence. Miscellaneous

 

The image of the Rental Agreement and other contractual documents is stored on a physically unalterable medium. You and AMA Rent A Car agree that this image will have the legal value of an original document. You agree that in the contractual relationship with the service provider you will use both a holographic signature on paper and an electronic medium and that the latter has the same legal effect as a holographic signature on paper.

In the event of a dispute you agree and authorize us to use in conciliation proceedings, proceedings initiated by a public authority, court proceedings or debt recovery activities through specialized persons/companies, any document or communication relating to your rental transmitted or received by any of the following means:

 by telephone (SMS or any other form of messaging from and to the contact numbers provided at the conclusion of the contract); e-mail from and to the e-mail addresses provided at the conclusion of the contract;

 postal or courier transmissions to the addresses indicated at the conclusion of the contract.

In the event of a dispute, the Contract Holder may not suspend its payment obligations or any other contractual obligations and may not invoke any right of retention in the absence of a court order of suspension. If any provision of this contract is or becomes void or unenforceable, all other provisions shall remain in force.
